ETHICAL GUIDELINES
Introduction and Definitions
Articles and translations submitted to YBHD shall be authentic, unpublished and in all circumstances, shall not be in a peer reviewing process for another publishing. Plagiarism, fraud, distortion, repeated publication, slicing (slicing an article or salami-slicing), unfair authorship, research/data fabrication, copyright infringements and concealment of conflict of interests are regarded as unethical acts and behaviors.
Stated unethical acts and behaviors are defined under Clause 1 of the Council of Higher Education Scientific Research and Publication Ethics Directive, Article 4 as follows:
Plagiarism: Presenting others' ideas, methods, data, applications, writings, shapes or works as if it were their own work without reference to scientific ethical rules,
Fraud: To use produced or distorted data that is not based on research in scientific researches,
Distortion: Distorting or shaping research results to falsify research records or obtained data, to show methods, devices and materials that are not used in the research as used, to falsify the data or results in line with the interests of individuals and organizations that support is received,
Repeated publication: To present repeating publications as separate works in academic appointments and promotions,
Slicing: To present the results of a research as separate works in academic appointments and promotions, disrupting the integrity of the research and disassembling it inappropriately, and making numerous publications without reference to each other,
Unfair authorship: Adding people who do not have an active contribution to the articles' authors or not including people who have an active contribution among the authors, changing the authors' order unjustly and inappropriately, removing the names of those who have an active contribution from the work during publication or in subsequent editions, including the name of others' among the authors who do not have an active contribution but exert their influence.
Research Ethics
For the scientific researches and translations in the field of legal studies, the phases of research subject, article or translation design, research data, research or translation text and feedback can be present. Compliance with the ethical principles to come up in these phases is under the Author's responsibility.
At these phases;
- Integrity, quality and transparency principles shall be abided,
- All private and legal entities (data providers, feedbackers, team of authors) who contribute to the creation of the work shall be informed about the issues that will come to the agenda, especially regarding personal data, upon the publication of the work,
- All private and legal persons who contribute to the creation of the work shall participate on a voluntary basis and the necessary permissions and approvals shall be obtained from them,
- Impartiality, clarity and transparency shall be sustained in accordance with the purpose of science.
Acts and behaviors that will be regarded as infringement of ethical principles in the event of noncompliance of the authors with the principles mentioned above, are stated under Clause 2 of the Council of Higher Education Scientific Research and Publication Ethics Directive, Article 4:
- Not indicating the sponsoring persons, institutions or organizations and their contributions in the publications in the researches conducted with their sponsorship,
- Using theses/dissertations or studies that are not defended or not submitted as a source, without the permission of the owner,
- Not complying with patient rights in their publications,
- To breach the provisions of the relevant legislations on human biomedical research or other clinical research,
- Sharing the information contained in a work that has been assigned for their review with others before it is published, without the explicit permission of the owner of the work,
- Misusing resources, places, facilities and devices provided or allocated for scientific research,
- To publish the data obtained in a questionnaire and attitude surveys conducted within the scope of a scientific study without the express consent of the participants, or if the research is conducted in an institution, also without the permission of the institution,
- Failing to comply with the obligation to inform and warn those concerned about possible harmful practices related to scientific research conducted by researchers or authorities,
- Not using the data and information obtained from other persons and institutions to the extent and as permitted in scientific studies, not respecting the confidentiality of this information or ensuring its protection,
- To make false or misleading statements regarding scientific research and publications in applications for academic appointments and promotions,
- To perform unexpected ethical attitudes and behaviors in an associate professor contrary to academic practices,
- To present a journal that is not included in the application file, or to show a journal that is not scanned in the indexes as it is scanned, or to specify a non-refereed journal as a refereed journal.
